GEORGE HAMMOND'S WILL (1794 - 1879)

In the Name of God. Amen!
I George Hammond of the Town of Angelica in the County of Allegany and State of New York, being of sound mind and memory and considering the uncertainty of the frail and transitory life do therefore make, ordaine, publish and declare this to be my last Will and Testament, that is to say:
First - - After all my lawful debts are paid and discharged I give and bequeath to my sons Nathan C. Hammond, William E. Hammond and Dwight F. Hammond, and to my daughters Eliza Hall, Mary Brown and Harriet Lord and my granddaughter Henrietta Green one hundred and fifty dollars each, the object of this bequest being to make each of the persons named equal with my daughter Olive Farmar to whom I have heretofore given one hundred and fifty dollars.
Second. I give and bequeath the remainder of my property both Real and personal to Nathan C. Hammond, William E. Hammond, Dwight F. Hammond, Olive Farmar, Eliza Hall, Mary Brown, Harriet Lord and Henrietta Green to be divided equally between them share and share alike.
Third. I empower and direct my Executor to sell all my real Estate and to give deeds thereof for the purpose of carrying out the will. I also direct that grave stones similar in every respect to those of my wife be erected at my grave.
Likewise I make constitute and appoint my son William E. Hammond to be executor of this my last will and Testament hereby revoking all former wills by me made.

In Witness Whereof I have hereunto subscribed my name and affixed by seal the 21st day of June in the year of our Lord one thousand eight hundred and seventy seven.
The above written instrument was subscribed by the said George Hammond in our presence and acknowledged by him to each of us and we at the same time declare the above instrument so subscribed to be his last Will and Testament and we at his request have signed our names as witnesses hereto in his presence and in the presence of each other, and have written opposite our names our respective places of residence.

Surrogate Court
In the Matter of Proving the Last will and Testament of George Hammond late of the Town of Angelica Allegany Co,. N. Y. Deceased
Allegany County, ss.
David P. Richardson and George S. Arnold being first duly sworn in open Court upon their several corporeal oaths, each for himself doth depose and say that he is a subscribing witness to the last Will and Testament of George Hammond late of the town of Angelica in the County of Allegany and state of New York deceased. And these deponents do further say, that the said George Hammond deceased, did, in the presence of each of these deponents, subscribe his name at the end of the instrument in writing which is now here shown to these deponents and which purports to be the last Will and Testament of the said deceased and which bears date on the 21st day of June, one thousand eight hundred and seventy-seven.
That the said deceased did at the time of subscribing his name to the said instrument as aforesaid, declare the same to be his last will and Testament; and these deponents did thereupon subscribe their own respective names at the end of said instrument as attesting witnesses to the execution thereof, each at the request of the said deceased, and in his presence and in the presence of each other. That the said deceased at the time of subscribing his name to said instrument as aforesaid and publishing said instrument as aforesaid was upward of twenty one years of age and a citizen of the United States; that he appeared to be, and deponents believe he was of sound mind memory and understanding and not under any restraint and as deponents verily believe in all respects competent to devise Real Estate; that each of these deponents saw the other sign his name to the said instrument in the presence of the said deceased.

"To the Surrogate of the county of Allegany
The Petition of William E. Hammond sole Executor of the last will & testament of George Hammond of the town of Caneadea in the County of Allegany, respectfully showeth:
That George Hammond late of the town of Angelica in the said County of Allegany deceased, died in said town of Angelica on or about the first day of December in the year of our Lord one thousand eight hundred and seventy-nine being at the time an inhabitant of the County of Allegany that he died, leaving a last Will and Testament which is now produced in Surrogate's Court of the said County of Allegany before the said Surrogate, which bears date the 21st day of June in the year of our Lord one thousand eight hundred and seventy-five and by which said last Will and Testament the said deceased nominated and appointed William E. Hammond our petitioner sole executor thereof; that the said deceased died possessed of both personal property & Real estate in the said County of Allegany and that the following named persons are all the heirs at law and next of kin of the said deceased and their respective ages and places of residence are as follows, viz:
Nathan C. Hammond son of said deceased residing at Williston Potter Co. Pa - Dwight F. Hammond son of deceased, Eliza Hall daughter of deceased Mary Brown daughter of deceased & Henrietta Green grand daughter of deceased all residing at Angelica Allegany County New York - Harriet Lord daughter of deceased also residing at Angelica Allegany Co. NY. Wm. E. Hammond your petitioner son of deceased and residing at Caneadea Allegany Co. NY and Olive Farmer daughter of deceased residing at Elmira in the State of California - All of said heirs & next of kin are of full age.
